摘要
在网络发展趋势下,人际沟通、就业工作、商业行为及娱乐活动都将在网络上进行,个人的私领域在现代社会被无形地、非自愿地挤压限缩。个人隐私受到了空前的威胁和挑战。网络隐私权的保护成为了隐私权法律制度中的热点问题。由于网络隐私权这一概念的正确界定对于确定网络隐私权的保护范围、侵权行为的认定等有着直接的影响,从而对立法与司法实务具有重要的意义,因此,本文对隐私、隐私权、网络隐私权的概念与特征进行了初步探讨。
With the development of the network, it's a tendency that the interpersonal communication, the employment, the business dealings and the recreational activities will all be carried out in the network. Under such circumstances, individual private domain in the modern society is invisibly, non-voluntarily extruded and shrunk. Individual privacy has met with the unprecedented threat and challenge. The protection of the privacy right in the network has become a hot topic in the right of privacy law system. Since a correct definition of the concept of the network privacy right has a direct affect on the protection extent, the recognition of the abuse of authority, etc., it has a vital significance to the legislation and judicial practice. This article is going to have a preliminary discussion on the concept and the characteristics of the privacy, the right of privacy, the network right of privacy.
