国际视野下的新冠疫苗知识产权豁免问题研究

摘要 面对新冠疫情持续反复甚至变异的威胁,“新冠疫苗是终结新冠疫情的有力武器”逐渐成为全球的共识。印度和南非向WTO提议暂时豁免新冠疫苗在TRIPS项下的知识产权义务,得到了众多发展中国家的支持。而后欧盟也向TRIPS理事会提交了一份宣言草案,认为可以通过TRIPS协定已有的药品专利强制许可来实现疫苗和药品的公平分配。如何解决新冠疫情下的国际公共卫生知识产权问题,平衡公共卫生健康与知识产权保护的利益,已经成为当前WTO最为紧要的任务。 Face the threat of the epidemic, “the COVID-19 vaccine is apowerful weapon to end the epidemic” has become a global consensus. In October2020, India and South Africa proposed to the WTO to temporarily waive the intellectual property obligations of the COVID-19vaccine under TRIPS, which has won the support of some developingcountries and the least developed countries. On June 18, 2021, the EuropeanUnion also submitted a draft declaration to the TRIPS Council, stating that theequitable distribution of vaccines and medicines can be achieved through thepatent compulsory license in the TRIPS Agreement. How to solve the problem ofintellectual property rights under the epidemic and balance the interests ofpublic health and intellectual property protection has become the most importanttask of the WTO.
