摘要
"坦白从宽"的口号在中国可谓家喻户晓,在刑事领域中已上升为法律。毋庸讳言,在卫生行政处罚实务中,不乏以"坦白从宽"要求当事人配合调查,且不失为行之有效的办案攻心技巧,但其适用一直处于混沌状态。由于卫生行政处罚对"口供"的过度依赖,甚至出现"坦白受罚,否则难罚"的窘境。这不可避免减损了公众对卫生行政执法的信任,既不利于卫生行政处罚的行政效率追求,也不利于卫生行政处罚中"坦白从宽"的社会教育和正面示范效果。对"坦白从宽"在卫生行政处罚中的可能路径及具体化、规范化进行粗浅探讨,希望能为提高卫生行政处罚效率和社会教育效果提供一孔之见。
The slogan of Leniency to Confessors is widely known in China and has risen to law in criminal law.Needless to say,in the practice of health administrative punishment,there is no lack of Leniency to confessors to require the parties to cooperate with the investigation,and it is an effective way to tackle the problem,but it′s application has been in a chaotic state.Because of the excessive dependence on confession in health administrative punishment,there is even a dilemma that confession is punished,otherwise it is difficult to punish.This inevitably impairs the public′s policy trust in health administrative law enforcement,which is not conducive to the pursuit of administrative efficiency of health administrative punishment,nor to the social education and positive demonstration effect of Leniency to Confessors'.In this paper,the possible path of Leniency to Confessors concretization and standardization in health administrative punishment are briefly discussed.
