摘要
'预付人权观'是我国学者赵汀阳提出的一个人权学说。预付人权观对天赋人权观的批判与扬弃主要围绕在四组对立的命题之中,构成了两种理论的争点。四个争点不是平行关系而是逻辑递进关系,人权关系问题的澄清是梳理争点并展开商榷的逻辑前提。人权的义务主体包括任何个人、社会组织和国家,人权法律关系亦是个人与上述主体间的关系。以此为起点,他对预付人权理论在人权制度的基本结构形态、道德价值、享有条件以及价值取向进行了讨论。预付人权理论所存在的问题是,一方面在于其对天赋人权的误读及其对社会契约论的忽视,这导致预付人权理论迷失了理论推进方向,而去试图解决许多已经被天赋人权理论解决了的问题;另一方面在于其理论旨趣的偏颇,其型构的预付人权理论并非是一个'道德的人权理论',而只是'道德人的人权理论'。
Credit Human Rights'is a human rights theory put forward by Chinese scholar Zhao Tingyang.The critique and sublation of the concept of Credit Human Rights on the concept of natural human rights revolves around the four sets of opposing propositions,which constitute the dispute between the two theories.The four disputes are not parallel but logically progressive.The clarification of the issue of human rights is the logical premise of sorting out the disputes and starting a discussion.This paper believes that the subject of human rights obligations includes any individual,social organization and state.Human rights legal relationship is also the relationship between the individual and the above-mentioned subject.From this as the starting point,the basic structure and moral value of the theory of Credit Human Rights in the human rights system,there are problems in terms of conditions and value orientations.The theory of Credit Human Rights is problematic.It stems from its misunderstanding of natural human rights and neglect of social contract theory,which leads to the theory of Credit Human Rights.Lost the direction of theoretical advancement,trying to solve many problems that have been solved by the theory of natural human rights;on the other hand,it is derived from the bias of its theoretical interest,and its pre-payment of human rights theory is not a'moral human rights theory',but only'The theory of human rights of moral people.
