摘要
正式解释即正式法律解释,是指由拥有法律解释权的主体做出的、具有法律效力的法律解释,是法律解释的核心和最重要的组成部分。正式解释源远流长,在法制史上影响深远。本文采用定义、语义分析、历史考察、分类、比较等方法,对古今中外正式解释进行梳理和整理,论述其独特性所在,寻求其产生和继续存在的真正理由。
As the core and the most critical component of legal interpretation, formal interpretation means formal legal interpretation, or the legal interpretation with binding legal force given by subjects with legal power to interpret. Formal interpretation boasts a long history and profound impact on legal system. By definition and semantic analysis, historical study, classification and comparison, the author has culled and systemized various Chinese and foreign formal interpretation cases, aiming at clarifying the particular characteristics of formal interpretation so as to seek for the origin of formal interpretation and the real reasons for its continuous existence.
