摘要
法律语篇是一种非常正式的书面语,其一个重要特征是规定应当承担的法律责任和义务,这种权力的体现手段之一就是情态词汇的准确运用。法律语篇不同于普通语篇,它对情态动词的选择和运用有着严格的要求。本论文就Palmer的研究模式对法律语篇中不同情态动词的细微情态意义进行分析,从批评语言学的角度解释其中蕴含的权力,企图探讨情态动词的运用和法律语言权力体现之间的内在联系,充实现有的国内法律语言研究。
Legal discourse is very formal and its main function is to stipulate legal duty and obligation parties are required to undertake. This power can be realized by the correct usage of modality in the legal discourse. Legal discourse quite differs from common discourses, which holds strict requirements for the choice and usage of modal words. This paper analyzes triple modal meanings of different modal verbs in legal discourse. Power inherited in it is explained and explored in terms of the relationship between modality and power realization in legal language. The result of the study also helps law drafters know clearer about legal language.
