摘要
生产者责任延伸制度在国内外的发展进程及学界研究表明其应在生态文明体制改革中占据核心位置。汉德公式理论为生产者责任延伸制度铺垫了坚实的理论根基,而实践中生产者法律责任界限不清、配套制度不足、监管机制欠缺等难点,致使制度运作无法达到预期生态目标。因此,提出了生产者责任分配的阶段化、支持性配套政策工具、行政机关和同侪监督等策略选择的方向,以期为生产者责任延伸制度的优化提供可行进路,再现其在生态文明体制中的位置。
The researches of the extended producer responsibility system at home and abroad indicates that it should occupy the core position in the reform of ecological civilization system.The hand formula lays a solid theoretical foundation for the extended producer responsibility system.However,in practice,the unclear boundaries of producer legal responsibility,insufficient supporting systems and the lack of regulatory mechanisms have made the system unable to achieve the expected ecological goals.Therefore,this paper puts forward the direction of strategy selection,such as the phased distribution of producer responsibility,supporting policy tools,administrative organs and peer supervision,so as to provide feasible approaches for the optimization of the extended producer responsibility system and reproduce its position in the system of ecological civilization.
