摘要
委托为本人与相对人意思表示一致的处理事务型合同 ,它是委托代理、信托、行纪、居间等合同的基础法律关系。创建以代理、信托、行纪、居间等法律制度为内容的委托法对民法的规范化、系统化极富价值。在法律建构模式上 ,适宜将委托制度作为一个相对独立的法律制度 ,同物权法。
A delegation contract,reached by the meeting of minds of the principal and the counterpart,is a basis of agency relation,trust relation,commission as well as brokerage relation.The establishment of delegation law,which centers on agency,trust,commission as well as brokerage law systems,will contribute to the systemization and the normalization of civil law.As to the model of the legal construction,delegation system should be regarded as a relatively independent legal system,which should be parallel with the real law and the obligation law to reflect its characteristics embodied in both real right and obligatory right.
