摘要
代理权授予行为是否具有独立性,直接影响到本人能否以单方行为授予代理权或撤销代理权而不必与代理人达成一致;代理权授予行为是否具有有因性,则直接决定着本人与代理人间的基础合同关系无效或撤销时,代理权授予行为是否归于消灭。为保护本人利益和维护交易安全,应在民法典中确立代理权授予行为独立性并无因性理论。
Whether or not the conferring of agency is of indenpendence will affect one to confer the right of agency by one side behavior, or cancel the right of agency and need not reach an agreement with the agent. Whether or not the conferring of agency is of causation will decide the invalidation of the foundation contract between the entruster and the agent, or the conferring of agency goes to be canceled. The independence of conferring of agency and uncausal theories should be established in civil code for the benefits of trade.
