摘要
模糊性治理是国家在治理主体、对象、目标等多重因素作用下所选择的一种社会组织治理方式,具有意图模糊、职责模糊、身份模糊等一系列特征。模糊性治理具有回应时代需求、提升国家治理能力等效度,同时也具有固化监护型控制逻辑、强化工具主义发展观等限度。模糊性治理会对形式法治和实质法治建设形成一定冲击,要实现模糊性治理的法治化转型,需要引入智慧法治的思路,一方面在形式法治层面构建“智能+”社会组织登记管理制度,实现社会组织治理的个体化、精准化,并形成社会组织立法方面的中央与地方协同用力;另一方面在实质法治层面需要合理运用智能科技手段,既实现从“单中心治理”到“合作治理”的全面转变,又通过“数字协商民主”的方式,努力提升社会组织参与公共决策的可能性和能力。
Ambiguous governance is a unique social organization governance model chosen by the government which is influenced by some factors such as governance subject,governance object and governance objective.Ambiguous governance model includes ambiguous intention,ambiguous duties and ambiguous role in the process of social organization governance.Although ambiguous governance model can respond to the needs of the Times to a certain extent and enhance the national governance capacity,it also has the limits of solidifying guardianship control logic and strengthening instrumentalism development view towards to the social organization.Especially,ambiguous governance model is liable to impact the construction of formal and substantive rule of law.Accordingly,in order to realize the transformation to the rule of law,it is necessary to introduce the idea of Intelligent Rule of Law.At the level of formal rule of law,the“smart+”social organization registration management system construction is highly needed so as to realize the individualization and precision of social organization governance,and form a centralized and local concerted effort in the legislation of social organizations at the same time.At the level of substantive rule of law,it is necessary to reasonably use intelligent scientific and technological means to realize the transformation from“single-center governance”to“cooperative governance”,and enhance the possibility and ability of social organizations to participate in public decision-making through the way of“digital consultative democracy”.
