摘要
《民法典》界定了身份权中配偶权、亲权和亲属权的内涵;确立了以损害赔偿为中心的侵权责任形式。身份权主体对外的绝对性特征塑造了其绝对请求权的保护基础。在法典体系化的影响下,侵权责任编以具有绝对权外观的部分身份权作为保护内容,形成以绝对权请求权为基础的侵权责任保护路径,排除诉讼时效的适用。在《民法典》总则编的涵摄下,婚姻家庭编与侵权责任编的协调成为亲属侵权救济的重要途径。体系化解释总则、婚姻家庭编、侵权责任编的关系,以绝对性外观为依据,身份权中的配偶权、亲权、亲属权侵权行为可以适用侵权责任编的规定,采用损害赔偿为主,停止侵害、排除妨碍、消除危险为辅的救济方式。
The Civil Code clearly defines the right of spouse,family and kinship in the right of identity;it establishes the form of tort liability centered on damages.Theory holds that the absolute characteristics of the subject of identity right shape the protection basis of its absolute claim.Under the influence of the systematization of the code,the tort liability law takes the partial identity right with the appearance of absolute right as the protection content,forms the tort liability protection path based on the absolute right of claim,and eliminates the application of the limitation of action.Under the general provisions of the Civil Code,the coordination of marriage and family and tort liability has become an important way for relatives to remedy tort.The systematic interpretation of the relationship between general provisions,marriage and family division,and tort liability is based on the absolute appearance,and the infringement of spouse right,parental right and relative right in the right of identity can apply to the provisions of tort liability division,and the damage compensation,stop the infringement,elimination of obstruction,elimination of danger as the auxiliary relief.
