摘要
地方探索是农村集体经营性建设用地入市制度改革的重要环节。《中华人民共和国土地管理法》2019年第三次修正后,地方政府就农村集体经营性建设用地入市进行了差异化探索,探索的内容在入市范围、主体、途径、方式、程序、收益管理等方面呈现多元样态。入市改革涉及重大利益调整,必须在实践中总结有益经验,审慎稳妥推进。随着入市探索逐渐普遍化,尚未开展入市试点的地区,应结合实际情况及时跟进。地方政府在推进入市改革时,应灵活设计入市规则,在允许多样化入市模式存在的同时,构建相对统一的入市制度安排。为强化入市保障,应加强规范制定,推进平台和组织体制建设,做好系统监管。
Local exploration is an important link in the reform of the system of rural collective commercial construction land marketization.After the third amendment of the Land Administration Law in 2019,local governments have conducted a differentiated exploration of rural collective commercial construction land marketization.The contents of the exploration has presented diversified patterns in terms of entry scope,subject,approach,method,procedure,and income management.The reform of entering the market involves the adjustment of major interests,and it is necessary to summarize useful experiences in practice and promote it prudently.With the gradual generalization of the exploration of rural commercial construction land entering the market,the places that have not carried out pilot projects should follow up in a timely manner according to the actual situation.When promoting the market entry reform,local governments should flexibly design the market entry rules,and build a relatively unified market entry system while allowing the existence of diversified market entry modes.In order to strengthen the guarantee of entering the market,the formulation of regulations and systematic supervision should be intensified,and the construction of the platforms and organizational systems should be promoted.
