摘要
《公共图书馆法》中的“硬法”条款效能不彰,其原因除了法律责任条款设置的不足,更重要的是监督检查有关规定的缺失。监督检查是行政执法过程中必然存在的独立的事中阶段,有关规定的缺失会导致执法人员不敢执法或不会执法,且与现代行政法基本原理与宪法对依法治国的共同要求不符,并导致《公共图书馆法》在整体结构上存在逻辑断裂。为此,需要在《公共图书馆法》中增加监督检查制度,规定对公共图书馆进行监督检查的主体、内容、措施和相应程序。
The ineffectiveness of the"hard law"provisions in the Public Library Law is not only due to the insufficient legal liability provisions,but also the lack of supervision and inspection related regulations.Supervision and inspection is an independent stage in the administrative enforcement process that must exist inevitably.The absence of related regulations will lead to law enforcement officers being unwilling or unable to enforce the law,and is inconsistent with the common requirement of the basic principles of modern administrative law and rule of law in the constitution law,and leads to a logical disconnection in the overall structure of the Public Library Law.Therefore,it is necessary to add a supervision and inspection system to the Public Library Law,specifying the entities,content,measures,and corresponding procedures for supervising and inspecting public libraries.
