摘要
提炼环境法价值,是建构中国自主的环境法知识体系的重要内容。应当在剖析中国环境法与传统法律的源流关系、与西方国家环境法的异同关系的基础上,厘清与归纳中国环境法的价值体系,具体包括:以“人与自然和谐共生”作为目的性价值,以传统法律一般法律价值在环境法领域的具体化和特色化作为工具性价值,以实现“可持续发展”和“中华民族的永续发展”作为未来的环境法的道德性价值。中国环境法从一般价值在一致性基础上实现内涵拓展、目的性价值的位阶擢升、道德性价值的功能创新这三个层次,实现了对传统法律价值的传承与拓展。一般价值层面在具有共性的基础上深嵌于各自法治体系、目的性价值/道德性价值存在异同、中西环境法重视各具特色的法律价值,中国环境法在这三个维度实现了对西方环境法价值的自主创新。
Refining the value of environmental law plays an important role in the construction of China's independent knowledge system of environmental law.Based on analyzing the origins of China's environmental law in relation to traditional law and the similarities and differences be-tween Chinese and Western environmental laws,it is necessary to clarify and summarize the value system of China's environmental law.Specifically,this includes:taking"harmonious coexistence between humanity and nature"as the purpose-oriented value,utilizing the specific and distinctive application of general legal value in the field of environmental law as the instru-ment-oriented value,and considering the realization of"sustainable development"and"the sustainable development of the Chinese nation"as the moral value of future environmental law.Through expanding the connotation of the general value on the basis of consistency,elevating the hierarchy of the purpose-oriented value,and innovating the function of the moral value,China's environmental law has successfully inherited and expanded traditional legal values.China's environmental law has also achieved independent innovation of Western environmental law value in three dimensions.First,the general value dimension is deeply embedded in the respective rule of law systems on the basis of commonality.Second,there are differences and similarities in the purpose-oriented value and the moral value.Third,both Chinese and West-ern environmental law attach importance to distinctive legal values.
