摘要
随着新文科建设所掀起的自上而下的中国人文社会科学的自觉学科变革,新法科也在新国情、新思想、新时代、新科技的呼唤中蓄势待发。本文基于多种实证研究进路,围绕中国化、信息化、交叉化、国际化等新文科建设的“四化”目标,量化分析了中国新法科的政策文本表达、理论研究动态以及高校实践现状,意在梳理和凝练高等教育决策者、法学教育研究者、法学院校实践者等利益相关主体聚焦新法科建设所达成的决策、理论与实践共识。在此基础上,本文提出了中国新法科的未来实践路径与建设方向:首先,应确立中国化在新法科建设中的根本和优先序位,探索构建中国特色法学三大体系,着力提升中国特色法学话语体系及其影响力;其次,应创新国际化法治人才培养模式,全方位支撑新时代国家发展战略需求;最后,还应扎实推进法学与其他学科的交叉化融合发展,并全面促进法科与信息化科技手段的良性互动。
With the self-conscious discipline reform of China’s humanities and social sciences from top to bottom initiated by the construction of new liberal arts,the new science of law is also gaining momentum in the call of new national conditions,new thoughts,new times and new technologies.Based on a variety of empirical research approaches,this paper focuses on the“four goals”of the construction of new liberal arts,such as Sinicization,informatization,cross-discipline and internationalization to make a quantitative analysis of the policy texts expression,theoretical research trends and the current situation of university practice in China’s new science of law.The purpose is to sort out and condense the decision-making,theoretical and practice consensus reached by higher education decision-makers,legal education researchers,law school practitioners and other stakeholders focusing on the construction of new science of law.On this basis,the paper puts forward the future practice path and construction direction of new science of law in China:Firstly,the foundation and priority of Sinicization in the construction of the new science of law should be established;the three major systems of law with Chinese characteristics should be explored;and efforts should be made to improve the legal discourse system and its influence with Chinese characteristics.Secondly,it is necessary to innovate the cultivation model of international legal talent to comprehensively support the strategic needs of national development in the new era.Finally,the cross-disciplinary integrated development of law and other disciplines should also be solidly promoted,and the benign interaction between the science of law and information technology should be comprehensively promoted.
