摘要
新时代十年来,干部容错机制建设进程逐步得到国家倡导与推动,建设范围覆及地域与领域,全面融入社会治理,建立起案例指导制度,试以指导性案例引领容错实践法治进程,规范与案例双向推进的“有形”制度框架初步建立。但观照现实,干部容错机制制度运行难掩“低效”,效能释放未达预期,面临陷入公信力不足处境危机、容错免责条款入法入规张力明显、案例指导制度功能发挥乏力、案例说理可接受性羸弱等多重困境。当前,应坚持政策规律与能动性发挥、形式创制与实效生成、核心共识与领域特点“三个有机统一”,全面优化干部容错机制制度框架。同时,将公众参与制度化融入容错实践提升公信力,选取“抽象入法”方式入法入规达至“理念统合”,完善案例指导制度激活指导性案例指导功能,提升案例说理可接受性强化示范指引价值,促其从形式“有形”走向实质“有效”。
In the past ten years in the new era,the fault tolerance mechanism for cadres has been in the working thanks to the advocacy and advance by the State,reaching various regions and covering different industries and being fully integrated into social governance,which is demonstrated the establishment of a case guidancesystem for practicing the rule of law in fault tolerance and of a“tangible”institutional framework for two-way advancement of norms and cases.However,the operation of the fault tolerance mechanism of cadres is difficult to overcome its“low efficiency”and is faced with multiple difficulties such as the crisis of insufficient credibility,the obvious tension of the fault tolerance exemption clauses to be written into the law,the weak function of the case guidance systemand the low acceptability of the case reasoning.At present,we should adhere to the“three organic unity”of policy-law initiative,form creation-effective generation and conformity-local characteristics to comprehensively optimize the system framework of cadres’fault tolerance mechanism.At the same time,it is important to institutionalize public participation in fault-tolerant practice to enhance credibility,to select“abstract entry into law”to achieve“concept integration”,to improve the case guidance system to activate the guiding case guidance function,to enhance the acceptability of case reasoning to strengthen the value of demonstration guidanceand to promote it from being“tangible”to substantively“effective”.
