摘要
民事检察和解是检察机关承担社会治理任务时所做的创新,在矛盾积压于检察环节无法疏导的当下,其适用确有必要。实践中民事检察和解存在扩张适用之嫌,适用方式偏于实质化和职权化,适用范围延伸至其他不必要的案件类型,适用条件没有与适用契机相区分。检察机关的法律监督本位要求民事检察和解的适用必须是有限的。应当明晰民事检察和解的适用边界,于规范化中衡平社会治理任务和法律监督本位之间的张力:在引导方式上,保持谦抑适度,尊重当事人的和解意愿;在案件范围上,限于生效裁判监督案件和民事支持起诉案件;在适用条件上,明确特定事由,与适用契机相区分。唯此,方能防止行政权能与司法权能的界限混淆,以保证民事检察和解的精准适用。
The civil procurate-hosted reconciliation is the innovation of the people’s procuratorate responding to the task of social governance.At present,the contradiction is overpiled in the procuratorial procedure and cannot be alleviated,so its application is indeed necessary.In judicial practice,there is the suspicion of extended application of the civil procurate-hosted reconciliation,for instance,the pattern of application tends to be substantial and authoritative,the scopes of application extend to other unnecessary types of cases,and the conditions of application are not differentiated from the opportunities of application.The duty of legal supervision of the people’s procuratorate requires that the application of the civil procurate-hosted reconciliation must be limited.Therefore,it is necessary to clarify the applicable boundary of the civil procurate-hosted reconciliation,and balance the tension between the task of social governance and the duty of legal supervision in the standardization:the application patterns should be modest and moderate to respect the will of the parties,the application scopes should be limited to the cases of supervising effective judgment and civil-supported prosecution,and the application conditions should be clear and distinguished from application opportunities.Only in this way can we prevent the boundary of administrative power and judicial power from being confused,so as to ensure the accurate application of the civil procurate-hosted reconciliation.
