摘要
告知承诺是行政审批制度改革的重要举措,通过采取政府告知、企业承诺、优化审批的模式,加快项目审批,提高行政效率。近几年,我国实施建设项目环境影响评价告知承诺审批相关试点工作,在促进复工复产、防疫项目建设方面发挥了积极作用。与此同时,告知承诺在环评领域应用也存在不适用性,包括缺乏法律支撑、企业获得感不高、环评优化作用未发挥、存在环境风险等。这些问题的产生与环评制度的设计理念、告知承诺制相关配套措施、社会环境、企业观念等有关。为推进环评告知承诺制的应用,建议合理界定适用项目范围,搭配规划环评、区域评估等政策一体推进,同时不断完善相关配套制度。
Notification and commitment system was an important measure for the reform of administrative examination and approval,while it accelerated project approval process and improved administration efficiency by adopting the mode of government notification-enterprise commitment-approval improvement.In recent years the pilot work of notification and commitment approval in Environmental Impact Assessment(EIA)of construction projects was carried out in our country,which played an active role in promoting the resumption of production and the construction of epidemic projects.However,the application of notification commitment approval in EIA was also inapplicable,including the lack of legal support,low sense of enterprise acquisition,ineffective optimization of EIA,environmental risks,and so on.These problems were related to the design concept of EIA,the supporting measures of notification and commitment system,social environment,enterprise concept,etc.In order to promote the application of notification commitment system in EIA,it was recommended to define reasonably the scope of projects suitable to application of notification and commitment system,propel plan EIA,regional assessment policies together,and improve constantly supporting systems.
