摘要
近年来,一些国家较为密集地通过书面文件、高官演讲等形式,积极表达本国对于网络空间国际法核心问题的主张。在网络空间规则博弈趋于白热化背景下出现的这一独特现象,既有西方国家利用其话语优势塑造网络空间国际规则的因素,也在一定程度上顺应了网络空间加快建章立制的客观需要。这些立场声明作为各国围绕相关国际法问题的论辩,在宏观层面涉及网络空间不同规则发展路径的选择,微观层面则涉及现有国际法规则如何适用于网络空间以及通过国家实践和法律确信的表达来塑造新的习惯规则等问题。但是,现有国家立场在内容表达的共识度和深入度、发声国家数量和代表性等方面还存在较大的局限性。中国应当高度关注网络空间国家立场声明的发展态势,通过更加积极、有效的立场表达,深度参与网络空间规则博弈。
In recent years,some countries have actively expressed their positions on the core issues of international law in cyberspace in written papers and speeches of senior officials.This unique phenomenon,which emerged in the context of the intensifying game of international rules in cyberspace,is driven by the Western countries' use of their discursive power to shape international rules in cyberspace,and is also partly consistent with the objective need to accelerate the rule-making process in cyberspace to a certain extent.These national positions,as argumentation of various countries on the relevant international legal issues,constitute the choices among various countries regarding development of international rules for cyberspace at the macro-level,while at the micro-level related to the issues of applying existing international law in cyberspace,and shaping new customary rules in cyberspace through expressions of relevant state practice and opinio juris.However,there are still major limitations of the existing national positions in terms of the degree of consensus and the depth of content expression,as well as the number and representativeness of the countries that have made statements.China should pay close attention to the development trend of national position statements in cyberspace,and deeply participate in the game of rules in cyberspace through more active and effective position expression.
