摘要
通过运用文献资料法、比较法等对体育自治进行研究,揭示体育自治是我国体育强国建设的重要保障。体育自治的发展程度与《体育法》密切相关:在原《体育法》时代,我国体育自治存在制度落后、保障缺位、权利受限等问题,以致难以发挥实际效用。新《体育法》对体育自治进行了针对性的完善,如构建权利本位体系、专章规定体育组织制度、增设体育仲裁制度等,基本形成符合我国现实需求的理论体系。为使《体育法》更好促进体育自治发展,应在现有立法基础上进一步加强与国际立法衔接、推进配套制度建设及规范体育组织内控制度等。
The study of China's sports autonomy using the methods of literature and comparison,reveals that sports au-tonomy is an essential guarantee for constructing China's sports power.The degree of development of sports autonomy is closely related to the Sports Law:in the era of the former Sports Law,China's sports autonomy had problems such as backward system,lack of security,and limited rights,which made it difficult to play its practical role.The new Sports Law has made targeted improvements to sports autonomy,such as building an a rights-based system,provi-ding a particular chapter on sports organization system,and adding a sports arbitration system,forming a theoretical system with Chinese characteristics.In order to make the Sports Law better promote the development of sports au-tonomy,we should further strengthen the connection with international legislation,promote the construction of sup-porting systems,and standardize the internal control system of sports organizations based on existing legislation.
