摘要
网络购物是经营者与消费者以网购平台为媒介进行的新兴交易方式。为了获取利润,经营者会通过刷单提高搜索排名、抢占市场和吸引消费者,但这侵犯其他经营者和消费者的合法权益,影响市场秩序。因此,亟需修改《反不正当竞争法》以规制网购市场,保障网购行业健康有序发展。修改措施主要包括:扩大法律责任主体范围,纳入参与者;明确处罚规定,细化各责任主体的处罚;加大处罚力度,威慑刷单行为;明确平台责任,赋予监管权利并建立奖惩机制;畅通司法救济途径,降低举证难度和诉讼难度,鼓励受害者维护权益;完善宣传普法制度,减少刷单行为的发生。以上修改将更好地规制网络刷单,保护消费者和经营者的合法权益,并促进网购市场的良好运行。
Online shopping is an emerging trading method where businesses and consumers engage in transactions through online platforms.In order to gain profits,businessmen engage in brushing activities by manipulating search rankings and capturing market share so as to attract consumers.However,these actions infringe upon the legitimate rights and interests of other businessmen and consumers,thereby producing negative impact on market order.Hence there is an urgent need to amend The Anti-Unfair Competition Law to adapt to the online shopping market.The proposed amendments mainly include expanding the scope of legal liability to contain participants,specifying punishment provisions and detailing the penalties for each party involved,increasing the severity of penalties to deter brushing activities,clarifying platform responsibilities,granting regulatory rights,and establishing reward and punishment mechanisms,ensuring accessible judicial remedies by reducing the burden of proof and litigation difficulties,thus encouraging victims to protect their rights,improving the promotion of legal awareness to reduce the occurrence of brushing activities.These revisions will better regulate online brushing,protect the legitimate rights and interests of consumers and businessmen and promote the healthy operation of the online shopping market.
