摘要
涉职务犯罪企业适用第三方机制的实践遇到监检衔接不畅的问题,需要对《关于建立涉案企业合规第三方监督评估机制的指导意见(试行)》第19条进行教义学阐释。职务犯罪第三方机制中的监检模式呈现出监察约束式、检察支配式和监检合作式三种样态。监检合作式的第三方机制立足于权力约束、协商正义与效益价值的法理本质,充分考量和借鉴了职务犯罪的复合法益特殊性以及域外反腐败合规的经验,彰显了职务犯罪有效合规的要求。通过明确检察院提前介入涉职务案件监察程序的案件标准、方式、时间以及检察建议内容,厘清监察机关第三方机制建议的实体与程序内容,创设第三方机制的监督机制,进而促就有效的第三方监管,达成对涉职务犯罪企业的综合治理。
In the practice of applying the third-party mechanism to enterprises involved in duty crimes,the procedures of supervisory organs and procuratorial organs are not smoothly connected,so it is necessary to interpret the doctrine of Article 19 of the Guiding Opinions on Establishing the Third-party Supervision and Evaluation Mechanism of Compliance of Enterprises Involved in Work-related Crimes(Trial).There are three types of supervision and inspection of the third party mechanism of duty crimes:supervision constraint,procuratorial domination,and supervision and inspection cooperation.Based on the jurisprudence nature of power constraint,consultation justice and benefit value,the third-party mechanism of supervision and inspection cooperation fully considers and draws lessons from the particularity of the compound legal interests of duty crimes and the experience of anti-corruption compliance outside the region,demonstrating the requirements of effective compliance of duty crimes.By highlighting the case standard,method,time and the content of suggestions for the procuratorate to get involved in the supervision procedure of duty crimes in advance,it clarifies the entity and procedure content of the third-party mechanism,and establishes effective supervision mechanism for the comprehensive management of the enterprises in duty crimes.
