摘要
风险社会下,刑事立法不断入侵行政法领域使得行刑法域的界限日渐模糊。行刑交叉案件在司法适用中出现了“时而激进时而保守”的不合理现象,直接原因在于没有厘清行刑法域的违法性判断关系。在我国“定性+定量”的刑事立法话语体系下,承认“一般违法性”在刑事违法性判断中的前提性地位不仅在立法层面有法律依据而且在司法层面有真实案例支撑。刑事相对从属说能够尊重整体法秩序本身固有的阶层构造,兼顾体系性思考和问题性意识,是解决行刑交叉问题的最优解。以“独立判断行刑法域所保护的利益”为起点,以“法益在质上是否一致”来决定刑事违法的从属程度为归宿这一二重递进判断规则是刑事违法性判断的实然路径。
To risk society,the criminal legislation constantly invades the area of administrative law and blurs the boundaries of its jurisdiction.In judicial application of administrative and criminal law in cross cases,it is improperly used so that it is“sometimes radical and sometimes conservative”.The immediate cause is that the determination for the violation is not clarified.According to“qualitative+quantitative”discourse system of criminal legislation in China,the determination of“general illegality”in criminal cases is not only supported by legal basis in the legislative level,but also supported by cases at the judicial level.The theory of relative subordination considers the inherent hierarchical structure of the integrated legislation,balancing the systematic thinking and issue consciousness,which is the optimal solution to the cross cases regarding administrative and criminal law.It starts from“the independent judgement for the interests protected by administrative and criminal law”,and determines the degree of subordination of criminal violations based on“whether the interests are qualitatively consistent”.The rule of duo judgement is the objective determination for criminal offenses.
