摘要
内容精细化是提升黄河流域省际协同立法实效的关键。黄河流域相较其他流域具有整体性的显著特征,生态问题彼此嵌套影响,既有的条块分割机制难以满足黄河流域整体性保护与治理要求,同时当前省级地方立法也有表面化与割裂化问题,立法供给不足。为满足黄河流域治理的实际需要,需更好提升省际协同立法的实际效果,在梳理立法现实需求及现存阻碍的基础之上,可以从细化跨省生态补偿制度、完善省际沟通协调机制、明确各省治理责任以及强化跨省协同监管四方面切入,提升黄河流域协同立法的治理实效。
Content refinement is the key to improve the effectiveness of inter-provincial collaborative legislation in the Yellow River Basin.Compared with other river basins,the Yellow River Basin has a significant feature of integrity.Ecological problems in the Yellow River Basin have nested impacts on each other,and the existing segmentation mechanism hardly meet the requirements of the overall protection and governance of the Yellow River Basin.At the same time,the current provincial local legislation is also superficial and fragmented,and the legislative supply is insufficient.In order to meet the actual needs of governance of the Yellow River Basin,it is necessary to improve the actual effect of inter-provincial collaborative legislation.On the basis of sorting out the actual needs and existing obstacles of legislation,the governance effectiveness of the Yellow River Basin collaborative legislation can be improved from four aspects:refining the inter-provincial ecological compensation system,improving the inter-provincial communication and coordination mechanism,clarifying the governance responsibilities of provinces,and strengthening cross-provincial collaborative supervision.
