摘要
黄河流域生态环境脆弱,地形地貌复杂多样,致使不同流域间生态差异性较大。近年来随着黄河流域生态保护和高质量发展战略的推进,黄河流域生态环境整体上得到了基本改善,但局部区域环境恶化问题仍较为突出,从而阻碍着黄河流域的可持续发展。《黄河保护法》是中国第二部流域法律,为黄河流域环境保护和高质量发展奠定了法律基础。政府作为生态环境的首要责任主体,在流域环境治理过程中有着重要作用。但政府在落实黄河流域环境治理责任的过程中与应然目标存在一定差距:缺乏部门间的协同机制;过分强调事中监管和事后治理,对事前的风险预防关注不足;忽视公众环境理性,无法有效协调“多元共治”主体间的关系;缺乏相应的司法监督保障。在今后实施《黄河保护法》的过程中,黄河流域环境治理的政府责任实现,需要建立协同工作机制,促进部门间的高效信息沟通;落实公众参与制度,发挥民主的环境治理效能;树立风险预防理念,黄河流域政府环境治理的前瞻性布局;构建司法监督体系,实现环境治理的司法保障。
The ecological environment of the Yellow River Basin is fragile,and the landform is complex and diverse,resulting in great ecological differences between different watersheds.In recent years,with the promotion of ecological protection and high-quality development strategy of the Yellow River Basin,the ecological environment of the Yellow River Basin has been basically improved on the whole,but the problem of environmental degradation in some regions is still prominent,which hinders the sustainable development of the Yellow River Basin.The Yellow River Protection Law is the second river basin law in China,which lays a legal foundation for environmental protection and high-quality development of the Yellow River Basin.As the primary responsibility subject of ecological environment,the government plays an important role in the process of basin environmental governance.However,the government has some gaps with its desirable goals in the process of implementing the environmental governance responsibility of the Yellow River Basin:Lack of inter departmental coordination mechanism;Excessive emphasis on in-process supervision and post event governance,and insufficient attention to risk prevention in advance;Neglecting public environmental rationality;Being unable to effectively coordinate the relationship between the“multi governance”subjects;Lacking the corresponding judicial supervision guarantee.In the process of implementing the Yellow River Protection Law in the future,to realize the government’s responsibility for environmental governance in the Yellow River Basin,it is necessary to establish a cooperative mechanism to promote efficient information communication among departments;Implement the public participation system and give play to the democratic environmental governance efficiency;Establish the concept of risk prevention and the forward-looking layout of environmental governance of the Yellow River Basin by the government;Build a judicial supervision system to realize the judicial guarantee of environm
