摘要
学位撤销制度属于《学位条例》修订的重要内容之一。现行学位制度对学位撤销功能定位模糊,导致学位撤销行为定性与法律适用的认识分歧。我国学位撤销的功能应当是对学位授予决定的有限纠错,且不宜承载惩罚功能。以学位撤销的有限纠错功能为基础,学位撤销条件的依据、内容与时效应当受到限制,学位撤销程序应当受到内部程序与外部程序的双重限制。未来《学位法》不应将学位撤销条件设定依据扩大至法律以外的规范,基于学位成果质量进行学位撤销宜采用“明显不符合标准”,并增加学位撤销的时效要件。此外,《学位法》还应当明确学术撤销的正当程序原则,确立学位撤销遵循的基本程序,并建构类型化的学术撤销特殊程序。
The degree revocation system is one of the important contents of the revision of the Academic Degree Regulations.The vague positioning of the function of degree revocation in the current degree system has led to the divergent understanding of the characterization and legal application of degree revocation.The function of degree revocation in China should be a limited correction of the decision of degree conferment,and it is not appropriate to carry the function of punishment.Based on the limited corrective function of degree revocation,the basis,content and time limit of degree revocation conditions should be restricted,and the degree revocation procedure should be subject to both internal and external procedures.The Academic Degree Law should not expand the basis for setting the conditions of degree revocation to norms other than the law,and it is appropriate to adopt obviously inappropriate standards for supervision of the quality of degree achievements and increase the time limit for degree revocation.The Academic Degree Law should clarify the principle of due process of academic revocation,establish the basic procedures of academic revocation,and construct the special procedures of academic revocation in a typology.
