摘要
《土地管理法》第66条第3款新增了集体经营性建设用地使用权协议收回的法律规范,但实践中,法院在适用该条款时,面临着规范冲突、规范不明确以及规范空白的困境。究其根源,乃在于该条款作为不完全条款缺失系统性和整体性。经由农村土地使用权收回制度体系的关联适用、公私规范融合体系的整合适用以及城乡建设用地一体化规范体系的区分适用,《土地管理法》第66条第3款获得了成为完全条款的制度基础。基于此,集体经营性建设用地协议收回规范,可以通过区分内部和外部两层规范,来确定主体适用规则;通过区分公法层面的行政行为以及私法层面的流转交易两个阶段,来确定行为适用规则;通过区分《民法典》合同编和物权编的规定,来确定内容适用规则,从而确定《土地管理法》第66条第3款的具体适用规则,进而促进集体经营性建设用地入市中权利的自治运行。
Article 66(3)of the Land Administration Law adds a new legal norm of collective business construction land use right agreement for repossession.However,in practice,the court is faced with the dilemma of conflicting norms,unclear norms and normative gaps when applying this provision.The root cause is that,as an incomplete provision,the provison lacks systematic and holistic arrangement.From a systematic perspective,through the application of the system of rural land use right recovery,the integration of the system of public and private norms and the differentiated application of the system of urban and rural construction land integration,Article 66(3)of the Land Administration Law has gained the institutional basis to become a complete provision.Based on this,the rules of application of the collective management construction land agreement can be determined by distinguishing between internal and external norms to determine the rules of application of the subject.It can also distinguish between the administrative acts at the public law level and the two stages of the flow transactions at the private law level to determine the rules of application of the act,and distinguish between the provisions of the Contracts Chapter of the Civil Code and the Property Chapter of the Civil Code to determine the rules of application of the content,so as to determine the rules of application of Article 66(3)of the Land Administration Law.The specific rules of application of Article 66(3)of the Land Administration Law are determined,thus promoting the autonomous operation of rights in the market of collective business construction land.
