摘要
文章以司法领域国有建设用地使用权出让、国有土地使用权收回的性质划分为契机,从行业管理的角度对出让国有建设用地使用权收回的条件、性质和补偿内容进行梳理。通过分析发现,出让国有建设用地使用权收回过程中存在收回条件的公共性政策、行政行为与民事行为界定不清,公共利益与不可抗力的关联性不足,补偿内容存在责任归属不清、涵盖范围不足等问题。建议在改革国有建设用地用益物权、建立统一的国有土地市场的基础上,将因公共利益实施的出让国有建设用地使用权收回改为国有建设用地使用权征收,并通过对接国土空间规划明确征收主体、优化管制模式。
This paper takes the judicial field of state-owned construction land use right transfer,the nature division of withdrawing the use right of state-owned land as an opportunity,from the perspective of industry management,it sorts out conditions,nature and compensation content of the use right of transferred state-owned construction land.Through analysis,it is found that in the process of withdrawing the use right of transferred state-owned construction land,there are some problems,such as unclear public policy,unclear administrative behavior and civil behavior,insufficient correlation between public interest and force majeure,unclear attribution of responsibility and insufficient coverage of compensation content.It is suggested that on the basis of reforming the usufructuary right of state-owned construction land and establishing a unified state-owned land market,withdrawing the use right of transferred stateowned construction land for public interests should be changed into the expropriation of the use right of state-owned construction land,moreover,there is a need to clarify the subject of collection and optimize the mode of regulation through the alignment of territorial and spatial planning.
