摘要
我国法律规定,商品房预售实行备案制度。合同备案不影响合同效力。为保护商品房预购人合法权益,应建立预告登记制度。预告登记的法律性质是为保全将来取得房屋所有权而为的请求权登记,其应具有本登记的溯及力效力。
In China, the statute regulates that the register system is implemented in housing presale. The contract register doesn't affect the contract validness. To protect the legal interest and equity of the house prebuyers, pre-register system should be implemented. The legal nature of it is to protect the interest and equity of the holders.
