摘要
绿色发展理念下,环境法课程内容的定位是回应环境法绿色发展转型和践行环境法绿色发展理念。我国现有的局限于法律部门内部调试的环境法课程内容,难以实现对绿色发展理念的彰显;彰显不足表现为,扎根于法律部门的多样化环境法教材和局限于本部门内生调试的差异化占比都未能达到绿色发展理念对广泛性的要求。立足于绿色发展理念对环境法课程内容揭示、解释以及解决人类所面临的环境问题的任务要求,应以领域法为视角设置环境法课程内容;在对传统环境法律规范系统分类的基础上,在环境法课程中融入宪法、民法、刑法、行政法等内容。绿色发展理念下,完善环境法课程内容的配套路径包含环境法律规范的系统汇总、环境法授课教师的多专业选用和多样化环境法课程形式的甄选等方面。
With the concept of green development,the orientation of environmental law teaching content is to set to respond to the transformation of green development of environmental law and practice the concept of green development of environmental law.The current environmental law curriculum content in China is limited to the internal debugging of the legal department,which is difficult to actualize the concept of green development.Both the diversity of environmental law teaching materials rooted in the legal department and the differentiation ratio limited to the internal debugging of the department fail to meet the requirements of the green development concept for universality.Based on the task requirements of revealing,explaining and solving the environmental problems faced by human beings by the concept of green development,the content of environmental law course should be set up from the perspective of domain law.On the basis of systematic classification of traditional environmental legal norms,the contents of constitution,civil law,criminal law and administrative law are needed to be integrated into environmental law courses.Under the concept of green development,the supporting ways to improve the content of environmental law courses include systematic summary of environmental law norms,multi-specialty selection of environmental law teachers and selection of diversified environmental law course forms.
