摘要
中国式现代化是不同于西方国家的具有中国特色的现代化发展道路,法治是实现中国式现代化的重要保障。人与自然和谐共生是中国式现代化的基础与保障,实现人与自然和谐共生是环境法治的历史使命。通过完善环境法治,促进人与自然和谐共生,能够为中国式现代化的实现提供环境法治保障。在中国式现代化的目标背景下,环境法治应当从立法、执法、司法、守法四个层面加以完善。要进一步完善法律规范,促进良法善治,提高生态环境领域国家治理体系和治理能力的现代化水平,推动构建“绿色”司法保障体系,运用环境法治促进环境教育,提升公众生态文化素养。
Chinese path to modernization is a development path with Chinese characteristics different from western countries,and the rule of law is an important guarantee to achieve Chinese path to modernization.The harmonious coexistence of man and nature is the foundation and guarantee of Chinese path to modernization.Realizing harmonious coexistence of man and nature is the historical mission of environmental law.By improving the environmental rule of law and promoting the harmonious coexistence of man and nature,it can provide the environmental legal guarantee for the realization of Chinese path to modernization.In the context of the goal of Chinese path to modernization,environmental rule of law should be improved from four aspects of legislation,law enforcement,judicature and law-abiding.We need to further improve legal norms,promote good law and governance,enhance the modernization level of the national governance system and governance capacity in the field of ecological environment,promote the construction of a “green” judicial guarantee system,use environmental rule of law to promote environmental education,and enhance the public's ecological and cultural literacy.
