摘要
我国环境治理领域正在探索“社区共管”“自然保护小区”等社区治理模式,但其普遍呈现功能上的补正性、机制的缺位性和法律定位的模糊性等特征,与当前构建环境多元治理体系的要求并不相符。应以多元共治理念为指引,廓清自然保护地社区治理机制的内涵与外延,系统展开自然保护地社区治理的机制构造。即构建完善的社区治理共管机制,以转变实践中机制功能的补正性;构建规范的法律体系,以矫正现行机制的缺位性、消除法律定位的模糊性;完善责任机制,以赋予社区治理的可问责性。
In the field of environmental governance,various forms of community governance such as"community-based co-management"and"nature mini-reserve"have been explored,but they generally show the problems of functional correction,mechanism vacancy and legal ambiguity,which are not consistent with the current requirements for building an environmental multi-governance system.Guided by the idea of multiple governance,we shoud clarify the connotation and extension of the community governance mechanism on protected areas,then systematically construct the mechanism from the following aspects:improving the co-management mechanism of community governance to change the feature of functional correction in practice,constructing a normative legal system to fll the vacancy of legal mechanism and eliminate the ambiguity of legal positioning,and ensuring the accountability of community governance through the construction of responsibilitymechanism.
