摘要
法典化是通过立法将特定领域的法律规定整合至一个逻辑严密、统一完备的规范体系的过程。法典编纂往往以独立的部门法为前提,同时还需要特定部门法完备自足,能够提取法律总则,具备成熟的理论体系。当前我国教育法的独立部门法定位存疑,公法规范与私法规范交融,同时还面临解法典化的冲击。相较于宪法、行政法、民法、刑法等其他部门法,教育法基础理论研究仍显薄弱。我国推动教育法典的编纂,应遵循法典编撰的基本规律,重视我国教育法法典化面临的多重挑战,在将教育法定位为“领域法”的基础上,采用“法典+单行法”的立法模式,以公私二元划分为基础建构教育法典的规范体系。我国应分阶段逐步推进教育法的法典化。
Codification is the process of integrating legal provisions in specific areas into a logically rigorous and unified normative system through legislation.Codification is often premised on independent sectoral laws,at the same time requires that specific sectoral laws be complete,general principles extractable,and have a mature theoretical system.At present,the position of China's education law as an independent department law is questionable,public law norms and private law norms are blended and it is also facing the impact of decodification.Compared with other sectoral laws such as the Constitution,administrative law,civil law,and criminal law,the basic theoretical research of education law is insufficient.In the process of promoting the codification of education,China should follow the basic laws of codification,fully consider the multiple challenges faced by the codification of China's education law,and on the basis of positioning education law as a"domain law",adopt the"code+separate law"legislative model,construct the normative system of the education code based on the dual division of public and private.China should gradually promote the codification of the education law in stages.
