摘要
国家公园生态保护补偿中受偿环节的实践做法不一,相关法律法规不完善,使生态保护补偿的激励作用难以充分发挥。基于相关司法案例和已有法律规范,分析有关国家公园生态保护补偿中受偿环节的现有规则。结果表明:受偿条件及其关系不清,缺乏对生态保护条件的重视和对各条件的综合考量;受偿权利的事前事后保障不到位,重义务轻权利;受偿者义务不明确,且义务履行的判断与监管不规范,影响着生态保护的效果。提出应明确受偿条件及受偿条件间的并存关系并为受偿权利的享有和救济提供法律依据、重视生态保护义务的重要地位、以生态服务价值综合判断义务履行情况、加快职权整合落实国家公园管理局在国家公园生态保护补偿上应有的统筹管理职责等建议。
The practices of ecological protection compensation for national park vary,and the relevant laws and regulations are incomplete,making it difficult to give full play to the incentive role of the ecological protection compensation.Based on the relevant judicial cases and existing legal norms,the existing rules of the compensation for ecological protection in national parks were analyzed.The conclusion shows that repayment conditions and the relationship therebetween are unclear,the attention paid to ecological protection conditions and the comprehensive consideration of various conditions are not given;the protection for the right to be repaid is inadequate,which emphasizes obligations over rights;the obligations of the repaid party are unclear,the judgment and supervision of the performance of the obligation are not standardized,which affects the effect of ecological protection.So it proposed to clarify the conditions of compensation and the coexisting relationship between the conditions of compensation,provide legal basis for the rights of compensation,attach importance to the importance of ecological protection obligations and judge the performance of obligations comprehensively by the value of ecological services,and accelerate the integration of powers to implement the National Park Administration′s overall management responsibilities in the ecological compensation of national park.
