摘要
对于传统中国土地交易中典与当二者有无实质区别的问题,学界存在明显分歧。从清至民国时期官方规制与民间实践认知两个主要维度进行考察的基本结论是,无论是历届政府有关土地典当制度的官方表达,还是绝大多数地域社会民间立契时的行文表达和日常感受,都足以表明该时期的土地典、当二者在总体上无实质区别,在研究时不宜作严格区分。
There are obvious disagreements in academia on the cognition of whether there is a substantial difference between Land Dian and Dang Sale in tra-ditional Chinese land transactions.The basic conclusion of examining the issue from the two main dimensions of official expression and folk practice cognition from the Qing Dynasty to the Republic of China is that,whether it is the official expressions of the previous governments on the land Dian sale system or the writ-ings of the majority of regional societies when the civil deeds were signed Expres-sions and everyday feelings,it is sufficient to show that there is no substantial difference between the two,and it is not appropriate to make a strict distinction during research.
