摘要
针对我国城市边缘社区环境治理薄弱的状况,文章提出以包容性规制推进环境治理转型,实现边缘社区环境善治。包容性环境规制转型逻辑涵盖价值、制度、结构、过程、转向维度,须秉持“以人民为中心”的价值理念,将法律法规的强制性与社区治理的包容性有机结合,兼顾环境治理的有效性与社会公平性,强调党委和政府是环境规制体系的设计者、协商谈判的组织者、治理秩序的维护者、基本公共服务的提供者,注重环境治理中的平等参与、协商合作、价值包容、利益共享、效能提升,充分保障弱势群体的生存发展权益。包容性环境规制转型推进路径上,须构建全过程包容性规制体系,建立资源充足稳定投入机制,完善奖惩机制,培育包容性社区文化,促进智慧社区治理。
Aiming at the problem of the weak environmental governance in urban fringe communities in China,this paper proposes the transition to inclusive environmental regulation to achieve good environmental governance in urban fringe communities.The logic of the transition to inclusive environmental regulation involves the dimensions of value,system,structure,process and direction.Inclusive environmental regulation adheres to the people-centered values,integrates the compulsion of laws and regulations with the inclusiveness of community governance,takes into account the effectiveness and social fairness of environmental governance,and emphasizes that Party committees and governments are designers of environmental regulation system,organizers of negotiations,maintainers of governance order and providers of basic public services.Equal participation,consultation and cooperation,value inclusiveness,benefit sharing and efficiency improvement should be emphasized in environmental governance,and the right to survival and development of vulnerable groups should be fully protected.To promote the transition to inclusive environmental regulation,efforts should be made to build a whole-process inclusive regulation system,establish an adequate and stable resource input mechanism,improve the reward and punishment mechanism,cultivate an inclusive community culture,and promote smart community governance.
