摘要
当前我国人体活体器官捐献法律制度尚不完善,突显出以下问题:活体器官捐献人范围过窄且缺乏适当补偿机制、器官交叉移植合法性仍未得到法律明确认可以及人体活体器官捐献管理机构主体不明等。基于活体器官捐献人自主意愿,为拓宽人体活体器官捐献渠道、保障受捐人生命健康权益,应当适度扩大活体器官捐献人范围,结合公平原则与道德风险防范理念,给予活体器官捐献人适当经济性或权益性补偿,同时明确赋予并合理设置中国人体器官捐献管理中心对活体器官捐献的管理职责。
At present, the legal system of human living organ donation in China is not perfect, highlighting the narrow scope of living organ donors and the lack of appropriate compensation mechanism, the legitimacy of organ cross transplantation has not been clearly confirmed by law, and the subject of human living organ donation management organization is unknown. Based on the independent wishes of living organ donors, in order to broaden the channels of human living organ donation and protect the life and health rights and interests of recipients, the scope of living organ donors should be appropriately expanded, and living organ donors should be given appropriate economic or equity compensation in combination with the principle of fairness and the concept of moral hazard prevention. At the same time, it’s necessary to clearly endow and reasonably set up the management responsibilities of China Human Organ Donation Management Center for living organ donation.
