摘要
先期处置是警情处理的首要步骤,处置不当会造成人民群众利益受损、警察被问责、警民关系紧张加剧等多重不利局面。通过对先期处置制度的历史沿革考察和实务考察,确立破除当前困境的逻辑构造为回归控制风险的功能本位。即明晰安全与秩序优先的执法价值,破除案前程序行政、刑事二分化的掣肘,同时完善处置主体、处置措施以及问责机制,通过一整套以功能本位为出发点的制度设计,实现先期处置控制风险的功能。
Early policing disposal is the first step in policing affairs handling and improper disposal will result in multiple unfavorable situations such as people’s interests being damaged, police officers being held accountable, and tensions between the police and the public being exacerbated. Through the review of the historical evolution and practice of early policing disposal system, this paper holds that the logical structure of getting rid of the current predicament is returning to the function of risk control. The value of safety and order should be first established, and the constraints of administrative and criminal dichotomy of pre-case procedures should also be broken. Besides, the disposal subjects,the disposal measures and accountability mechanisms should also contribute to the risk control through a whole set of system design based on function.
