摘要
法官参照案例以待决案件与案例相似为前提,认定案件相似的基础是两案事实相似。因案件事实是认识论意义上的事实,属于规范命题,所以,案件事实相似是在比较中项(中介规范)保证下的规范判断,即判断对比案件的案件事实能否分别与中介规范实现对应。考察涵摄方法中要件事实作为事实与法律规范对应方案,以及判例推理中法官自由裁量中介规范作为规范与事实对应方案,提出符合我国成文法制度要求的案件事实相似判断方法:其一,诉讼各方在法律规范范围内选择对比事实;其二,法官应尊重当事方的自决权,在当事方选择之对比事实的基础上选择对比事实,仅在当事方选择的事实越出法律规范范围时予以校正;其三,通过事实证立与诉讼程序控制验证事实相似认定结论。
Referring to the case,the judge takes the similarity between the pending case and the case as the premise,and finds that the similarity of the case is based on the similarity of the facts of the two cases.Because the fact of the case is a fact in the sense of epistemology and belongs to the normative proposition,the similarity of the case fact is the normative judgment under the guarantee of the middle item of comparison(intermediary norm),that is,to judge whether the case facts of the comparative case correspond to the intermediary norm respectively.Based on the investigation of the essential facts as the corresponding scheme between facts and legal norms in the inclusive method,as well as the intermediary norms of the judge s discretion in the case reasoning as the corresponding scheme between norms and facts,this paper puts forward a method for judging the similarity of case facts in accordance with the requirements of the statutory law system in China.First,the parties to the litigation choose the comparative facts within the scope of the legal norms.Second,the judge should respect the parties,the right of self-determination is to choose comparative facts on the basis of the comparative facts chosen by the parties,and only correct them when the facts selected by the parties are beyond the scope of legal norms;third,the conclusion of similar determination of facts is verified through the establishment of facts and the control of litigation procedures.
