摘要
在著作权各项子权利中,展览权较为小众,没有得到足够的理论关注。这种权利基础研究现状,与近年来我国文博事业的蓬勃发展不相匹配。随着现代技术的发展,面对越来越丰富多样的美术作品和展览样态,应当从实践出发解析和把握现行法上的展览权概念内涵,肯定其著作权属性,明确“公开”和“陈列”的内涵,进而合理界定其客体范围。针对作品原件转移后原件展览权的归属问题,我国著作权法第20条第1款所规定的“权随物转”突破了“权不随物转”的传统法理。相较于权利穷竭说、默示许可说、法定许可说,利益平衡说能够更好地揭示“权随物转”规则的法理基础。基于利益平衡的法理,著作权法第20条第1款尚存在一定的立法缺失,需要进一步完善。
Among all the sub-categories of the copyright,the right to exhibition is thought to be a minor issue and has not received enough theoretical attention.This inadequacy in the research on the basis of rights does not match the vigorous development of China’s cultural and museum undertakings in recent years.With the development of modern technology,in the face of more and more rich and diverse art works and exhibition patterns,we should analyze and grasp the connotation of the concept of exhibition right in the current law by taking legal practice into consideration,confirm its copyright attribute,clarify the connotation of “publicity” and “display”,and then reasonably define its object scope.In view of the ownership of the original exhibition right after the original works are transferred,the “rights to be transferred with things” stipulated in Paragraph 1 of Article 20 of the Copyright Law breaks through the traditional legal principle of “rights not to be transferred with things”.Compared with the theory of exhaustion of rights,the theory of implied license and the theory of statutory license,the theory of balance of interests can better reveal the legal basis of the rule of “rights to be transferred with things”.In addition,there are still some legislative deficiencies in the first paragraph of Article 20 of the Copyright Law,which need to be further improved.
