摘要
由于影响行政协议履行的客观事由更容易发生、法律适用的需要、弥补单方变更解除制度漏洞的需要、落实法律公平价值的需要等方面原因,行政协议裁判准用情势变更原则具有不可或缺的必要性。行政协议裁判准用情势变更原则司法实践中存在诸多问题,主要表现在忽视对“不可预见”的判断、情势变更与行政优益权混同处理、对“物价上涨”等情势变更事由的认定不统一等方面。对行政协议裁判准用情势变更原则予以完善,需要对情势变更构成要件进行总体设定,区分情势变更与不可抗力、商业风险,对“显失公平”予以具体判断,审查和判定情势变更与基于行政优益地位产生的变更解除权,并赋予行政主体基于情势变更提起诉讼的主体资格。
As the objective causes that affect the performance of the administrative agreement are more likely to occur,the need for the application of law,the need to make up for the loopholes of the unilateral change and remove system,the need to implement the fair value of law and other reasons,it is indispensable for the judgment of the administrative agreement to employ the principle of change of circumstances.There are many problems in the judicial practice of applying the principle of change of circumstances in the adjudication of administrative agreements,which are mainly manifested in the neglect of the judgment of“unforeseen”,the mixed treatment of change of circumstances and administrative preferential rights,and the inconsistent identification of the causes of change of circumstances such as“rising prices”.In order to perfect the principle of change of circumstances in the judgment of administrative agreements,it is necessary to set up the constituent elements of change of circumstances in general,distinguish between the change of circumstances and force majeure and commercial risks,make a specific judgment on“obvious unfairness”,review and determine the change of circumstances and the right to rescind the change based on administrative preferential status and endow the administrative subject with the subject qualification to file a lawsuit based on the change of circumstances.
