摘要
基于“双碳”目标和能源革命的驱动,应在系统观念下对我国能源法制进行“低碳化”改造,在注入“双碳”法律功能的同时使之与现行法制体系相兼容。鉴于现行能源法制的“双碳”欠缺与不足,我国能源法制应“补短板强弱项”,将“双碳”全面融入能源法制建设之中:确立能源“双碳”目标与能源转型目标、在贯彻多元理念的同时强化安全发展理念、突出协同原则、建立能源消耗“双控”与碳排放“双控”相结合机制、实现法律与政策的治理协同,并加强能源安全、能源科技、能源结构调整和转型、能源市场、能源治理等领域的“低碳化”法制建设。
Based on the “carbon peaking and carbon neutrality” goals and the drive of the energy revolution,the energy legal system of China should be “ low-carbon” systematically transformed under system concept,and make it compatible with the current legal system while injecting the “carbon peaking and carbon neutrality” legal function.In view of the lack and deficiency of “carbon peaking and carbon neutrality” in the current energy legal system,our energy legal system should “strengthen areas of weakness”,and integrate “ double carbon” into the energy legal construction:Establish the “ carbon peaking and carbon neutrality” goal of the energy and energy transformation goal,while implementing the concept of diversity strengthen the concept of safe development,highlight the principle of synergy,establish a mechanism to combine energy consumption “Dual Control” with carbon emissions “Dual Control”,achieve the collaborative governance of laws and policies,and strengthen “low carbon”legal construction in energy security,energy science and technology,energy structure adjustment and transformation,energy market,energy governance and other fields.
