摘要
DC/EP(Digital Currency Electronic Payment)是我国的法定数字货币,目前已在国内投入小场景应用试验,其正式投入使用后跨境流动的必要性和需求是客观存在的,而在“一带一路”沿线国应用DC/EP也是其跨境流动的逻辑必然,这将有利于提高人民币的国际地位。但DC/EP作为一种数字货币,面临的问题具有新的特点,如跨境效力上的货币主权与清算问题,跨境规制上的监管权和争议解决问题。为了更好地解决这些问题,就需要在规则上予以提前构思,加强规则制定的严谨性和协调性,以各种具体规则的探究作为突破其跨境流动困境的方法。
DC/EP is China’s Central Bank Digital Currency and has been put into small-scale application tri-als in China.The necessity and demand for cross-border flows after its official launch is objective,and the applica-tion of DC/EP in countries along B&R(the Belt and Road)is also a logical necessity for its cross-border flows,which will be conducive to enhancing the international status of the CNY.However,as a kind of digital currency,DC/EP faces new problems,such as the issues of currency sovereignty and clearing in terms of cross-border validi-ty,regulatory authority and dispute resolution in terms of cross-border regulation.In order to solve these problemsin better way,it is necessary to conceptualise the rules in advance,strengthen the rigour and coordination of rule-making,and use the exploration of various specific rules as a way to break through the dilemma of its cross-borderflow.
