摘要
"一带一路"倡议,是中国为促进包括基础设施建设、贸易、金融以及文化交流等在内的区域融合和全球合作,在多方面促进全球联结所做的重大举措。但西方个别大国为维护狭隘的本国利益,大搞单边主义和保护主义,在全球范围内制造贸易摩擦,让以世界贸易组织为核心的多边贸易体制受到冲击,国际经济合作和人类共同发展迎来逆流。在此情况下,构建"一带一路"公正合理的争端解决机制具有重大意义。尽管"一带一路"本质上为区域发展战略,然又不同于传统的区域一体化模式。这是因为,"一带一路"在突破传统的区域限制与闭塞的同时,也对现有的跨国争端解决机制提出了新的挑战。基于此,在分析目前国际争端机制的可行性与经验基础上,构建国际商事法庭、国际商事仲裁中心以及国际商事调解机制互相衔接的多元化纠纷解决机制,不断满足中外当事人纠纷解决的多元要求,形成一套公平公正、专业高效、透明便利且低成本的国际商事争端解决机制具有时代意义。
The"one belt and one road"initiative is a major step taken by China to promote global connectivity.Practice has proved that"one belt and one road"is the road of cooperation and winwin in carrying forward the spirit of the ancient Silk Road.However,in order to safeguard their narrow national interests,some western countries have made efforts to promote unilateralism and protectionism,create trade frictions all over the world,which adversely affected international economic cooperation and the common development of mankind.Under such circumstances,it is of great significance to construct a"one belt and one road"fair and reasonable dispute settlement mechanism.Although"one belt and one road"is undoubtedly a regional development strategy,it is also different from the traditional regional integration mode.This is because the"one belt and one road"has broken through the traditional regional restrictions and blocks,and no longer restricted the number and country of the members.Based on the analysis of the feasibility and experience of the current international dispute settlement mechanism,a multi-dimensional dispute settlement mechanism with links between the international commercial tribunal,the International Commercial Arbitration Center and the international commercial mediation mechanism should be established to continuously meet the multiple requirements of dispute settlement between Chinese and foreign parties and form a fair,professional,efficient,transparent,convenient and low-cost international commercial dispute settlement system.The mechanism is of epochal significance.
