摘要
商事调解因其具有能实质高效解决争议、维持友好关系等独特优势,日渐成为国际商事争议解决的通行方式。面对"一带一路"沿线国家的商事争议解决需求不断增长且日益多元的趋势,国家适时出台《关于建立"一带一路"国际商事争端解决机制和机构的意见》,为发展"一带一路"商事调解提供了巨大机遇。然而,无可否认的是当前发展"一带一路"商事调解仍面临着诸多现实挑战。唯有以共商共建共享为方向指引,重塑"一带一路"商事调解的基本理念和基本原则,并通过培育现代国际商事调解组织,建立国际商事调解职业队伍,明确商事调解协议执行机制,构建国际商事调解信用体系,方能有效应对发展"一带一路"商事调解的现实挑战。
Commercial mediation has become a popular way to resolve international commercial disputes because of its unique advantages such as substantial and efficient dispute resolution and friendly relations. In the face of the growing and increasingly pluralistic trend of demand for commercial disputes along the countries of the road,the state timely promulgated the views on the establishment of the settlement mechanism and institutions of the international commercial disputes,which provided a great opportunity for the development of＂BR＂commercial mediation. However,it is undeniable that the current development of the＂BR＂commercial mediation still faces many practical challenges. Only by taking the direction of joint construction and sharing as the direction,reinventing the basic concepts and basic principles of the＂BR＂commercial mediation,and cultivating a modern international commercial mediation organization,establishing an international business mediation professional team and clarifying the implementation mechanism of commercial mediation agreements and constructing an international commercial mediation credit system can we effectively cope with the realistic challenges of developing the ＂BR＂commercial mediation.
