摘要
随着大数据和人工智能的迅速发展,区块链技术在保障电子提单的流通方面优势明显,区块链技术可以保障电子提单信息的完整性,保证电子提单不被篡改、伪造,这为提单的电子化提供了可能。但是区块链技术的应用同样暴露出诸多的潜在风险,例如区块链自身的系统风险、上链前提单信息篡改以及对区块链法律规制不健全等,不利于区块链电子提单的流通应用。通过完善区块链证据的审查认定机制、建立区块链“跨链融合”模式、加强对区块链智能合约监管等方面的规则之治,填补法律空白,规避区块链在电子提单流通中产生的风险,可以促进区块链技术在国际航运中的推广与应用。
With the rapid development of big data and artificial intelligence,blockchain technology has obvious advantages in ensuring the circulation of electronic bills of lading,blockchain technology can ensure the integrity of electronic bill of lading information,and ensure that electronic bills of lading are not tampered with and forged,which provides a possibility for the electronicization of bills of lading.However,the application of blockchain technology also faces the systemic risks of the blockchain itself,the tampering of information on the premise of the chain,and the imperfect legal regulation of the blockchain,which is not conducive to the circulation and application of blockchain electronic bills of lading.By improving the review and identification mechanism of blockchain evidence,promoting the establishment of the blockchain "cross-chain integration" model,and strengthening the legal regulation of blockchain smart contracts in terms of supervision,the risks generated by blockchain in application can be effectively solved,and the promotion and application of blockchain electronic bills of lading in international shipping can be promoted.
