摘要
粉丝为了维护偶像的形象和市场利益而发生各种行为,这些行为可能导致对他人权益的侵害。相较一般的民事侵权归责,粉丝行为的侵权责任难以有效归结。如果基于控制论重新梳理粉丝、明星及其所属公司以及网络平台的关系,将他们作为一个系统整体中的组成部分,分析这个系统中粉丝行为控制者与侵权粉丝的关系,厘清控制者与侵权粉丝的法律责任,可以为解决粉丝侵权行为的归责问题提供一个新的路径。
Fans engage in various behaviors in order to maintain the image of idols and market interests,which may lead to infringement on the rights and interests of others.Compared with the general tort liability,the tort liability of fans’behavior is difficult to be concluded effectively.If the relationship among fans,stars,their companies and network platforms is reorganized based on cybernetics,and they are regarded as an integral part of the whole system,the relationship between fans’behavior controller and infringing fans in the system is analyzed,and the legal liability between controller and infringing fans is clarified,which can provide a new way to solve the problem of attribution of fans’infringing behavior.
