摘要
新一轮宅基地有偿使用探索正处于改革的深水区,亟需规范层面的支撑。但《民法典》《土地管理法》等对宅基地使用权的无偿性的规定并未发生变化。试点地区通过有偿费用的形式,突破了宅基地使用权的无偿性。主要包括以区位优势推动集中利用、改变用途与商业经营相结合、增减挂钩与统一交易三种有偿模式。宅基地“三权分置”的背景下,统一规范宅基地有偿使用制度对于推进试点的有偿使用是必要且可行的。从现行法律规范来看,宅基地有偿使用制度统一规范的基础权利存在缺失。为此,物权法可创设一项宅基地经营权,从区分物权属性与债权属性的使用权展开立法,从而实现宅基地使用权无偿分配与宅基地经营权有偿使用的统一规范。
The new round of exploration of the paid use of residential bases is in the deep water of reform and is in urgent need of support at the normative level.However,the provisions of the Civil Code,Land Administration Law and others on the gratuitous nature of the right to use residential bases have not changed.The pilot areas have broken through the gratuitous nature of the right to use residential bases through the form of paid fees.The three main models of paid fees include the promotion of centralized use by locational advantages,the combination of change of use and commercial operation,and the linkage between increase and reduction and unified trading.In the context of the“separation of the three rights”of residential bases,it is necessary and feasible to unify and regulate the system of paid use of residential bases in order to promote the paid use of pilot projects.From the existing legal norms,there is a lack of basic rights for the unified regulation of the paid use of residential bases system.For this reason,the property law can create a right to operate a residential base,distinguish the property attribute and the claim attribute of the right to use to start the legislation,so as to realize the unified regulation of the non-remunerated allocation of the right to use a residential base and the paid use of the right to operate a residential base.
