摘要
农村宅基地有偿使用制度改革应充分发挥市场机制的作用,按照一级市场和二级市场分类推动宅基地无偿分配逐步向城乡统一有偿使用制度转变,构建农村宅基地有偿使用的渐进市场化路径。一级市场上宅基地有偿使用的渐进市场化方式为:存量宅基地超占有偿→存量宅基地全部有偿;增量宅基地集体内部全部有偿→增量宅基地跨集体有偿使用,最终过渡到城乡统一的住宅用地一级市场有偿使用。二级市场上宅基地有偿使用的渐进市场化方式为:丰富宅基地使用权债权型有偿使用方式;宅基地使用权物权型“跨集体”有偿使用;城乡统一的住宅用地二级市场有偿使用。
The reform of paid use system of rural homestead should give full play to the role of market mechanism,and promote the transformation of free distribution of homestead to the unified paid use system in urban and rural areas according to the classification of primary market and secondary market to build the path of gradual marketization of reform of paid use system of homestead.The gradual marketization path of paid use of homestead in the primary market is the over-occupied paid use of‘stock’homestead,the all paid use of‘stock’homestead,the all paid use within the collective of‘incremental’homestead,the‘cross-collective paid use’of‘incremental’homestead,and the unified paid use of urban and rural residential land in primary market.The gradual marketization of paid use of homestead in secondary market is enriching the creditor’s rights way of compensation for using the homestead,the‘cross-collective paid use’of real rights for homestead,and the unified paid use of urban and rural residential land in secondary market.
