摘要
市场机制在价格形成的过程中存在缺陷,因此需要政府对价格进行干预。政府依法有效履行价格调控职能,不仅是建设服务型政府的要求,也是人民群众的现实需要。然而,现有的《价格违法行为行政处罚规定》在传统价格违法行为认定、新业态监管、违法涉企收费以及行政处罚罚则设定等方面存在一些问题,有必要在后续修订中予以解决,如应当对传统价格违法行为的构成要件予以细化、更新和补充,明确适用条件。在平台经济和双边市场的新市场结构以及大数据和人工智能等新技术手段背景下,新业态监管应当对大数据杀熟和平台低价倾销予以回应;应当强化涉企收费监管,明确行为准则,细化行为标准,设定处罚额度;应当制定科学的罚则,有效衔接比例罚与定额罚,设置合理有效的罚款额度。
The market mechanism is not free of flaws in the process of price formation,so government intervention is required.It is not only the requirement of building a service-oriented government,but also the practical needs of the people that the government effectively performs its price regulation functions according to law.However,the current Provisions on Administrative Penalties on Price Violations has some problems in the following aspects:the identification of traditional price violations,the supervision of new business forms and models,the illegal charges imposed upon enterprises,and the setting of administrative penalties.All these need to be resolved in the subsequent revisions.The constituent elements of traditional price violations should be refined,updated,and supplemented,and the applicable conditions should be clarified.In the context of the platform economy and the new market structure of the two-sided market,as well as new technologies such as big data and artificial intelligence,the supervision of new business forms should respond to such problems as big data swindling and low-cost platform dumping.The supervision of enterprise-related charges should be strengthened,the code of conduct should be clarified,the standards of conduct should be refined,and the amount of financial punishment should be well established.Scientific penalties should also be formulated,effectively linking proportional penalties with fixed penalties and setting a reasonable and effective amount of fines.
